Dr. Lucchetti is a QME -Qualified Medical Evaluator for the Industrial Medical Council.

A QME- Qualified Medical Evaluator (QME) is appointed and regulated by DWC Medical Unit, a QME assesses an injured worker’s permanent impairment and limitations and evaluates a wide variety of disputed medical-legal issues. What is workers' compensation?
Worker's compensation is a form of insurance that provides compensation medical care for employees who are injured in the course of employment, in exchange for mandatory relinquishment of the employee's right to sue his or her employer for the tort of negligence.

Workers' compensation is payment provided to employees when they are injured while at work. Negligence does not need to be shown in order to receive workers compensation. In order to receive workers' compensation, you have to have been employed at the time you are injured, and the injury must be a result of the employment. This means that your injuries must be caused by whatever tasks you are supposed to perform while employed.

Dr Lucchetti's presentation excerpt:

The topic of my discussion is “Returning Humanity to the California Workers’ Compensation System”. My focus will be on integrating human factors which include: positive self-esteem; role in the family; personal identity in regards to employment; and one’s self-fulfillment. It is the interrelationship between the injured the worker, treating doctors, the insurance professionals, lawyers, and representatives who that need to work collaboratively.

All of the individuals need to function within the Workers’ Compensation system so that there is an efficient system of care and rehabilitation, with the goal of returning to work as soon as possible. Mental health workers need to help an injured worker to form plans to facilitate their disability and return to a productive work environment.

When a worker becomes injured it causes changes in all of their relationships including family and co-workers. In keeping with the political climate in our country we need to understand that change is necessary and that “Yes we can change”. That includes making Workers’ Compensation be responsive to the needs of the injured worker as well as the profit motives of insurance companies. They are not diametrically opposed. If an injured worker’s needs are efficiently and effectively met it is possible the Workers’ Compensation system will become more cost effective.

It is in the best interest of our country, of our insurance industry, and of our people that the injured worker be returned to a productive life. The injured worker cannot be a victim. The worker must see himself as being capable of making the necessary changes. It is important to set realistic goals in helping return the injured worker to a life of productivity.

In management of chronic pain it must be accomplished so that a patient’s memory and mental acuity is not so impaired. It must be possible for the individual to function in the open labor market.
